Welcome to MWM Collective Co.!
The terms “we,” “us,” and “our” refer to MWM Collective Co. LLC, doing business as MWM Collective Co. We operate this website and online store, including the related information, content, features, tools, products, and customer services offered through it collectively, the “Services.”
Our store is hosted by Shopify, which provides the e-commerce platform that enables us to offer the Services to you.
These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies referenced in these Terms, explain your rights and responsibilities when accessing or using the Services.
Please read these Terms carefully. They contain important information regarding purchases, intellectual property, warranty disclaimers, and limitations of liability.
By visiting our website, creating an account, placing an order, or otherwise accessing or using the Services, you agree to be bound by these Terms of Service and our [Privacy Policy](/policies/privacy-policy).
If you do not agree to these Terms or our Privacy Policy, you may not access or use the Services.
SECTION 1 — ELIGIBILITY, ACCESS, AND ACCOUNTS
By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence, or that you are the age of majority and have authorized your minor dependents to use the Services under your supervision.
To browse our store, create an account, or purchase a product, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping address.
You agree that all information you provide will be accurate, current, and complete. You also represent that you have the legal right to provide that information and use the payment method submitted with your order.
You are responsible for protecting your account credentials and for activities conducted through your account. You may not sell, transfer, assign, or license your account to another person.
We reserve the right to refuse service, suspend accounts, cancel orders, or restrict access to the Services when reasonably necessary to prevent fraud, abuse, unlawful activity, policy violations, or harm to our business or customers.
SECTION 2 — PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to accurately display and describe our products, including their colors, materials, dimensions, designs, and other characteristics.
However, colors and product appearance may vary depending on your screen, device settings, lighting conditions, product size, printing process, garment color, and manufacturing variations.
Because many of our products are printed, embroidered, or otherwise produced after an order is placed, minor variations may occur between the product shown online and the product received. These minor variations are not necessarily defects.
Product mockups are provided for illustration and may not show the exact placement, scale, or appearance of a design on every product size or variation.
You are responsible for reviewing:
- Product descriptions
- Available colors and variations
- Sizing information and size charts
- Materials and care instructions
- Personalization details, when applicable
- Shipping estimates
- Your cart and order information before checkout
Sizing may vary among brands and product styles. Selecting the same labeled size across different products does not guarantee identical measurements or fit.
We may update product descriptions, specifications, pricing, availability, and images at any time without prior notice. We may also limit quantities, discontinue products, or restrict sales to certain people, locations, or jurisdictions.
SECTION 3 — MADE-TO-ORDER PRODUCTS
Many MWM Collective Co. products are made specifically for the customer after an order is submitted.
Once an order has entered production, we may be unable to:
- Cancel the order
- Change the selected size or color
- Change the product or design
- Change personalization details
- Change the delivery address
Please review your order carefully before completing checkout.
Made-to-order does not mean that every product is individually customized or personalized. It means that production or fulfillment may begin in response to the customer’s order.
Our made-to-order model and production process do not limit any consumer rights that cannot legally be waived.
SECTION 4 — ORDERS AND ORDER ACCEPTANCE
Submitting an order is an offer to purchase the products in your cart.
An automated order confirmation acknowledges receipt of your order. It does not necessarily mean that the order has been finally accepted or entered production.
We reserve the right to accept, decline, hold, or cancel an order for lawful reasons, including:
- Product unavailability
- Pricing or listing errors
- Suspected fraud or unauthorized payment activity
- Payment authorization failure
- Shipping restrictions
- Violation of these Terms
- Orders placed for unauthorized commercial resale
- Circumstances preventing fulfillment
If we cancel a paid order, we will issue a refund for the canceled portion to the original payment method.
We may contact you using the email address, telephone number, billing address, or shipping information provided with your order.
You agree to promptly respond when information is required to process or deliver your order. Failure to respond may result in delay or cancellation.
Unless we expressly authorize otherwise, products purchased through our store are intended for personal or household use and not for commercial resale, redistribution, or export.
SECTION 5 — ORDER CHANGES AND CANCELLATIONS
Orders may enter production shortly after they are placed.
To request a change or cancellation, contact us immediately at hello@mwmcollective.com with your order number.
Submitting a request does not guarantee that the order can be changed or canceled. If production or fulfillment has already begun, the request may be denied.
Orders containing personalized, customized, or made-to-order products cannot generally be changed or canceled after production begins.
Approved cancellations will be refunded to the original payment method. Financial institutions may require additional time to post the refund.
SECTION 6 — PRICES, PAYMENTS, AND BILLING
Prices, promotions, discounts, and product availability may change without notice.
The price charged will ordinarily be the price shown during checkout when the order is placed, subject to correction of obvious pricing or listing errors.
Unless expressly stated otherwise, displayed product prices do not include applicable:
- Sales or use taxes
- Shipping charges
- Customs duties
- Import taxes
- Brokerage fees
- Other government or carrier charges
Applicable charges will be displayed during checkout when they can be calculated by our systems.
You agree to provide accurate, complete, and current billing and payment information. You represent that you are authorized to use the submitted payment method and authorize our payment providers and us to charge the total displayed during checkout.
We may use third-party payment processors. Your payment information may be processed under the terms and privacy practices of those providers.
If a pricing, discount, product, or checkout error is discovered after an order is submitted, we may contact you to confirm the corrected information or cancel and refund the affected item.
SECTION 7 — PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes may be subject to additional conditions, including:
- Start and expiration dates
- Product or collection exclusions
- Minimum purchase requirements
- Usage limits
- Customer eligibility requirements
- Geographic restrictions
Unless expressly stated otherwise:
- Discount codes cannot be combined
- Discounts have no cash value
- Discounts cannot be applied retroactively
- Discounts do not apply to previous purchases
- Shipping charges, taxes, and gift cards may be excluded
- Promotions may be modified or withdrawn before an order is placed
We may reject or cancel the use of a promotion obtained or used through fraud, technical manipulation, unauthorized distribution, or violation of its stated conditions.
SECTION 8 — SHIPPING, FULFILLMENT, AND DELIVERY
Orders are subject to our [Shipping Policy](/policies/shipping-policy), which is incorporated into these Terms.
Production and delivery estimates are not guaranteed delivery dates unless we expressly state otherwise.
Products within the same order may be produced at different facilities or shipped separately. As a result, an order may arrive in multiple packages on different dates.
You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, failed deliveries, or additional costs caused by an incorrect or incomplete address provided by the customer.
Contact us immediately if you discover an address error. We cannot guarantee that an address can be changed after production or fulfillment begins.
Shipping carriers operate independently from MWM Collective Co. Carrier delays may occur due to weather, service interruptions, high-volume periods, customs processing, incorrect addresses, or other circumstances outside our reasonable control.
If we are unable to ship within the promised period, we will provide any notice, cancellation opportunity, or refund required by applicable law.
When tracking information indicates delivery, but you cannot locate the package, first check:
- The delivery address entered with the order
- Mailboxes, porches, side doors, reception areas, and other delivery locations
- Household members, neighbors, apartment offices, or building staff
- Tracking information and carrier notices
Then contact the carrier and MWM Collective Co. promptly so the issue can be reviewed.
Nothing in this section limits any rights or remedies available under applicable consumer-protection law.
SECTION 9 — RETURNS, EXCHANGES, AND REFUNDS
Returns, replacements, exchanges, and refunds are governed by our [Refund Policy](/policies/refund-policy), which is incorporated into these Terms.
Because many of our products are produced after an order is placed, we generally do not accept returns or exchanges based solely on:
- Buyer’s remorse
- Change of mind
- Incorrect size or color selected by the customer
- An incorrect or incomplete shipping address
- Minor differences in color, print placement, or appearance are inherent to the production process
However, damaged, defective, misprinted, or incorrect products may qualify for a replacement, refund, or other remedy under our Refund Policy.
Please inspect your order promptly after delivery and contact us within the period stated in our Refund Policy. We may require your order number, a description of the issue, and clear photographs.
Nothing in these Terms limits any rights or remedies that cannot legally be excluded.
SECTION 10 — INTELLECTUAL PROPERTY
The Services and their original content—including our branding, logos, store design, text, graphics, product photographs, artwork, illustrations, videos, and other materials—are owned by or licensed to MWM Collective Co. LLC unless otherwise indicated.
These materials are protected by applicable copyright, trademark, and other intellectual-property laws.
You may access and use the Services only for personal, lawful, and noncommercial purposes.
Without our prior written permission, you may not:
- Copy, reproduce, republish, distribute, or sell our materials
- Modify or create derivative works from our original artwork
- Remove copyright, trademark, or ownership notices
- Use our product images or descriptions to sell competing products
- Scrape, extract, download, or compile our content for commercial use
- Use our content to train, develop, or improve an artificial-intelligence system or commercial dataset
- Manufacture or sell products containing our original designs
- Use our name, branding, or content in a way that implies sponsorship or affiliation
“MWM Collective Co.” and associated logos, designs, names, and slogans are trademarks or branding assets of MWM Collective Co. LLC.
Third-party names, marks, characters, entertainment properties, and other intellectual property appearing on the Services remain the property of their respective owners.
Unless expressly stated, references to third-party brands or entertainment properties do not imply endorsement, sponsorship, authorization, or affiliation.
SECTION 11 — CUSTOMER CONTENT, REVIEWS, AND FEEDBACK
You may be able to submit reviews, photographs, comments, messages, ideas, suggestions, or other content, collectively called “Customer Content.”
You retain ownership of Customer Content you create. However, by submitting Customer Content to us or publicly tagging MWM Collective Co. in content clearly intended to feature our products, you grant us a nonexclusive, worldwide, royalty-free, sublicensable license to reproduce, display, adapt, publish, distribute, and use that Customer Content for operating, improving, and promoting our Services.
Where reasonably practical, we may identify you using the name or social-media username associated with the content.
You represent that:
- You own or have permission to submit the Customer Content
- Its use will not violate another person’s rights
- It is truthful and not misleading
- Any incentive or compensation connected to a review has been properly disclosed
- It does not contain unlawful, defamatory, abusive, obscene, or malicious material
- It does not contain malware, viruses, or harmful code
We are not required to publish, retain, compensate, or respond to Customer Content. We may remove or decline to publish content that violates these Terms or applicable law.
SECTION 12 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to tools, features, integrations, applications, or services operated by third parties.
Those services may be offered “as is” and “as available” and may be governed by separate terms and privacy policies.
We do not control every third-party service and are not responsible for its availability, security, accuracy, practices, or performance. Your use of third-party services is at your discretion and risk.
We may introduce new tools, integrations, features, and resources. Unless otherwise stated, they will be considered part of the Services and subject to these Terms.
SECTION 13 — THIRD-PARTY LINKS
The Services may contain links to websites, platforms, resources, or content operated by third parties.
A link does not necessarily mean that we endorse, control, or guarantee that third party.
We are not responsible for examining or evaluating third-party websites or for their:
- Content
- Accuracy
- Security
- Availability
- Products or services
- Privacy practices
- Business practices
Review the third party’s terms, policies, and practices before providing information or completing a transaction.
Questions or disputes involving a third party’s independent products or services should be directed to that third party.
SECTION 14 — RELATIONSHIP WITH SHOPIFY
MWM Collective Co. is powered by Shopify, which enables us to provide the Services.
However, purchases made from our store are transactions directly between you and MWM Collective Co. LLC.
By using the Services, you acknowledge that Shopify is not the seller of our products and is not responsible for the fulfillment, quality, safety, legality, or delivery of products purchased from MWM Collective Co.
To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to purchases and transactions made directly with MWM Collective Co.
SECTION 15 — PRIVACY
Personal information collected through the Services is handled in accordance with our [Privacy Policy](/policies/privacy-policy).
Because our store is hosted by Shopify, Shopify may collect and process information concerning your access to and use of the Services to operate and improve the Shopify platform.
Information may also be disclosed to fulfillment providers, payment processors, shipping carriers, analytics providers, marketing providers, and other service providers when reasonably necessary to operate our store, complete transactions, prevent fraud, fulfill orders, and provide customer service.
Please review our Privacy Policy for additional information about how personal information is collected, used, shared, retained, and protected.
SECTION 16 — ERRORS, INACCURACIES, AND OMISSIONS
The Services may occasionally contain typographical errors, inaccuracies, or omissions involving:
- Product descriptions
- Product availability
- Prices
- Promotions
- Shipping charges
- Production estimates
- Delivery estimates
- Product photographs
- Sizing or other specifications
We reserve the right to correct errors, update information, or cancel affected orders when information is inaccurate, including after an order has been submitted.
If we cancel a paid order due to an error on our end, we will issue a refund for the whole amount to the original payment method.
We are not obligated to update or clarify every item of information except as required by law.
SECTION 17 — PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:
- Violate any applicable law or regulation
- Infringe our rights or another person’s rights
- Commit fraud or submit unauthorized payment information
- Harass, threaten, abuse, defame, or harm another person
- Submit false, deceptive, or misleading information
- Impersonate another person or organization
- Transmit spam, malware, viruses, or malicious code
- Interfere with the operation or security of the Services
- Circumvent access controls or security measures
- Collect another person’s personal information without authorization
- Scrape, copy, extract, reproduce, or commercially exploit store content
- Use automated systems in a manner that places an unreasonable burden on the Services
- Purchase products for unauthorized resale or counterfeiting
- Attempt to reverse engineer or misuse any part of the Services
We may suspend or terminate access to the Services when we reasonably believe a user has violated these Terms.
SECTION 18 — TERMINATION
You may stop using the Services at any time.
We may suspend or terminate your access to the Services, cancel an account, or refuse future service if we reasonably determine that you have violated these Terms, engaged in fraud or abuse, created a security risk, or acted unlawfully.
Termination does not eliminate payment obligations or liabilities arising before termination.
Provisions that by their nature should continue after termination will survive, including provisions concerning intellectual property, customer content, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.
SECTION 19 — DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services and products are provided on an “as is” and “as available” basis, except for any express warranty or guarantee stated by MWM Collective Co.
We do not represent or warrant that:
- The Services will always be available, uninterrupted, secure, or error-free
- Every error will be corrected immediately
- Product colors will appear identical on every screen
- Every product will meet subjective preferences or expectations
- Information available through the Services will always be complete or current
To the fullest extent permitted by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, title, durability, and noninfringement.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.
Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.
SECTION 20 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, MWM Collective Co. LLC and its members, officers, employees, contractors, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to the Services or products.
This includes, without limitation:
- Lost profits or revenue
- Lost data
- Business interruption
- Replacement costs
- Loss of opportunity
- Losses arising from reliance on website content
Where liability cannot legally be excluded, our total liability arising from a particular purchase will not exceed the amount paid for the product giving rise to the claim, except when applicable law requires a different remedy or amount.
These limitations apply regardless of whether a claim is based on contract, negligence, tort, strict liability, statute, or another legal theory.
Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, this section applies only to the fullest extent allowed by law.
Nothing in these Terms limits liability for fraud, intentional misconduct, or any other liability that cannot legally be limited.
SECTION 21 — INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless MWM Collective Co. LLC and its members, officers, employees, affiliates, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal expenses arising from:
- Your material breach of these Terms
- Your violation of applicable law
- Your violation of another person’s rights
- Customer Content submitted by you
- Your fraudulent, abusive, or unauthorized use of the Services
We will provide reasonable notice of an indemnifiable claim. You agree to cooperate in its defense reasonably.
This obligation does not apply to claims caused solely by our own unlawful conduct or negligence to the extent prohibited by applicable law.
SECTION 22 — SEVERABILITY
If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed as necessary.
The remaining provisions will continue in full force and effect.
SECTION 23 — WAIVER AND ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms, together with all policies and notices incorporated by reference, constitute the entire agreement between you and MWM Collective Co. regarding your use of the Services and supersede prior communications or agreements concerning the same subject.
SECTION 24 — ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, change in ownership, or transfer of business operations, subject to applicable law.
SECTION 25 — GOVERNING LAW AND JURISDICTION
These Terms and any dispute arising from or relating to the Services or products will be governed by the laws of the State of Ohio and applicable federal law, without regard to conflict-of-law principles.
Unless applicable law provides otherwise, the parties consent to the jurisdiction of the appropriate state and federal courts located in Ohio.
Nothing in this section prevents a customer from exercising a consumer right or remedy available under the mandatory laws of the jurisdiction where the customer resides.
SECTION 26 — CHANGES TO THESE TERMS
The current version of these Terms is available on this page.
We may update these Terms to reflect changes to our Services, business practices, technology, policies, or legal obligations.
Changes will become effective when posted unless a different effective date is stated. When required by law, we will provide additional notice of material changes.
Your continued use of the Services after the revised Terms become effective constitutes acceptance of those revised Terms.
Changes will not retroactively alter the essential terms of an order already accepted unless permitted by law or agreed to by the customer.
SECTION 27 — HEADINGS
Headings are included for convenience and organization only. They do not limit or otherwise affect the interpretation of these Terms.
